EU law – legal services in your interests. Counselling and representation related to EU law in EU institutions

A large part of our activities is related to EU law. Certain fields fall within the sole competence of the European Union and in certain fields the Union shares competence with Member States. For instance, the customs union and competition rules (incl. state aid) fall within the exclusive competence of the EU. The EU and Member States share competence, among other things, in the field of agriculture, the environment, consumer protection and energy.  Thus, when looking for a solution to a problem, one often needs to focus on EU law, in addition to Estonian law. EU law is developed by the Court of Justice of the European Union which, in turn, means that the case-law of the Court of Justice of the European Union may contain an answer to the client’s problem, be it related to state aid or recovery of payments, assistance or support or questions concerning value added tax.

If a question of the interpretation and validity of EU law arises in a national court, the national court has a chance and in certain cases also the obligation to ask for a preliminary ruling from the Court of Justice of the European Union. The submission of a request for a preliminary ruling suspends the proceedings in the national court until the Court of Justice of the European Union has rendered its decision.
